Copyright & IP Complaints

Version . Part of the Terms of Service.

1. Our approach

Antelier stores projects, assets and Publications at users' direction. We respect intellectual property and expect users to do the same. We respond to notices that meet the Digital Millennium Copyright Act (17 U.S.C. §512) and to other good-faith IP complaints.

2. Copyright infringement notices

Email hello@antelier.co with the subject "Copyright notice." Your notice must include:

  1. your physical or electronic signature;
  2. identification of the copyrighted work you say is infringed (or a representative list if there are several);
  3. identification of the material you say infringes, with information reasonably sufficient for us to find it, such as the Publication link;
  4. your name, address, telephone number and email address;
  5. a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and
  6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.

When we receive a valid notice, we remove or disable access to the material promptly and tell the user who provided it.

3. Counter-notices

If your material was removed and you believe it was a mistake or misidentification, email a counter-notice to hello@antelier.co with:

  1. your physical or electronic signature;
  2. identification of the material removed and where it appeared before removal;
  3. a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; and
  4. your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district where Antelier may be found) and that you will accept service of process from the person who sent the notice.

We send the counter-notice to the complaining party. Unless they tell us within 10 business days that they have filed a court action, we restore the material within 10 to 14 business days after receiving the counter-notice.

4. Repeat infringers

We end the Workspaces of users who are repeat infringers in appropriate circumstances. We count valid, uncontested notices and weigh them against successful counter-notices.

5. Other intellectual property complaints

For trademark, publicity, trade secret or other rights complaints, write to hello@antelier.co with your contact details, the rights involved, the material, and why you believe it is unlawful. We review these case by case.

6. Intimate images shared without consent

Requests to remove intimate images of a real person shared without consent follow the Acceptable Use Policy. We act on valid requests within 48 hours.

7. False claims

Under 17 U.S.C. §512(f), a person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, can be liable for damages. Consider fair use and other defenses before sending a notice.
